Distance contract

The seller of the goods offered in this online store SIA “AGM orthopaedics” Reģ.nr. 42103076971, Riga, Palangas street 5 – 7, LV-1055, on the one hand, hereinafter referred to as the Seller, and the person placing the order, hereinafter referred to as the Buyer, on the other hand, conclude the following contract: The Seller undertakes to sell and deliver the goods to the Buyer in accordance with the Buyer’s order.

Delivery and payment procedure

The Buyer orders the goods on this website, indicating the type and quantity of goods ordered. The Buyer has the opportunity to pay for the goods using the payment instruments offered by the Seller, or by paying for the order invoice prepared by the Seller and sent to the Buyer to the e-mail address specified by him. The invoice is issued electronically and is valid without a signature. After successful payment of the order, the Buyer receives an e-mail confirmation of payment and information about the delivery of the goods.

When paying using a credit- or debit card (VISA, Mastercard and other local cards), the amount of the order is immediately authorized.

All payments that are conducted with a credit- or debit card are made via our secured Payment Service Provider (PSP) which uses SSL (Secure Sockets Layer) in encrypted form providing high-level security from the customer in accordance with the international security standard PCI DSS. All credit- and debit card holders are subject to validation- and authorization control by the card issuer. 

The Seller in the territory of Baltic states ensures the delivery of the goods within 5 (five) working days, in some cases within 10 (ten) days (if the goods are not in stock at the time of order), from the moment of receipt of payment for the goods. The Seller agrees on the delivery time with the Buyer. Delivery time for delivery outside the territory of Latvia depends on the selected delivery service. When choosing a delivery company “DPD” or “DHL”, the Buyer receives an order tracking code.

Prices for delivery of goods

The Seller, in cooperation with the delivery service provider DPD and DHL express, ensures the delivery of parcels in the territory of Latvia, while the Buyer chooses to receive the goods in one of the DPD parcel vending machines.

The Seller, in cooperation with the delivery service provider, also ensures the delivery of the order to the delivery address specified by the Buyer by courier.

The Seller will inform the Buyer about the cost of delivery outside the Baltic States at the time of placing the order – before paying for the order and using DPD or DHL carrier.

The cost of delivery and delivery time depend on the region of delivery and the delivery method chosen by the Buyer. Reliable information on the terms of delivery is provided to the Buyer at the time of placing the order – before payment for the order. If the country chosen by the Buyers as the destination of delivery is located outside the European Union, the Buyer must additionally cover all costs associated with the customs clearance of the goods and the delivery of the goods themselves.

Right of withdrawal

Asummetria offers a 14 day return policy, which means that you can return items you have ordered to Asummetria within 14 days from the date you received your order. The item being returned must be unused, in undamaged condition and have all tags and item packaging intact. The returned items shall, as far as possible, be packaged in the same way as when the items were received.

If trying on beachwear or underwear, please ensure that these items are tried on over your own underwear and please do not remove the hygiene seal.

For hygiene reasons, Asummetria cannot offer refunds of exchanges for:

Beachwear or underwear if in either case the hygiene seal has been removed or if Asummetria reasonably believes the items have been worn (other than for the purposes of trying on in accordance with the above).

Refund of the returned item takes place within 14 days from when we received the item.

Faulty items

In case of the manufacturing fault the Buyer has the right to refuse the Goods within 14 calendar days from the date of receipt of the Goods by sending the Seller a letter of withdrawal to the Seller’s e-mail address: info@asummetria.com or postal address: the store “Asummetria”, Graudu Street 46, Liepaja, LV-3401 or by selecting any other method of delivery of the recall letter, informing the Seller in advance about it. The item being returned must be unused, in undamaged condition and have all tags and item packaging intact.

The Buyer is obliged to return the goods to the Seller within 7 (seven) days after sending the recall letter. All costs incurred in connection with the return of the goods to the Seller are covered by the Buyer. The goods can be returned using one of the delivery services or personally in the Seller’s store “Asummetria”, Liepaja, Graudu street 46, LV-3401. The Seller transfers to the buyer the commission (the price at which the goods were purchased) for the returned goods to the buyer to the bank account from which the purchase was made, no later than within three (3) working days after receipt of the goods, if the goods were returned without damage, signs of use, in their original packaging and in the condition in which they were at the time of shipment.

The buyer cannot exercise the right of return (revocation) if:

1. The buyer intentionally or unintentionally damaged the ordered goods;

2. the ordered goods were produced directly to the Buyer by individual order.

Article 12(6) of the Law on Consumer Protection of the Republic of Latvia states that “the consumer is responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal”. The Seller reserves the right to refuse the Buyer the right to refuse or withhold a compensation fee in the event of damage to the goods, neglect of the goods during use or non-compliance with the instructions for the instructions, if the original packaging of the goods has been lost or if its packaging is significantly damaged.

Cancellation Policy

The Buyer has the right to review and cancel the order immediately by informing the Seller about the cancellation of the order, to call the Seller during working hours by phone +371 20 169 569 or by sending a refusal to the e-mail address specified on the Seller’s website: info@asummetria.com. Cancellation of the order can be made within one hour from the moment of order confirmation. You must provide the order number that you want to cancel.

Exchange of goods

The purchased product can be exchanged for an identical product of a different size or color, if the original labels and packaging are preserved for the goods. The exchange of goods can be carried out using DHL or DPD (using a return code) or in person, in the store “Asummetria”, Liepaja, Graudu street 46, LV-3401, no later than within 14 calendar days after receipt of the goods. If the exchange is not possible immediately, the Seller has the right to exchange within 7 working days from the date of the request.

Gift card Terms and Conditions

Gift card is valid until the expiration date mentioned in your gift card. Default gift card is valid for one year after purchase.
It can be used for any purchase on our website, including sale items only once.
The gift card value is not redeemable for cash and cannot be refunded.
If your order total exceeds the gift card value, you can pay the remaining amount with your preferred payment method.
If your order total is less than the value of the Gift Card, please note that the remaining balance cannot be stored for future use. You must utilize the full Gift Card amount during your current purchase, as it cannot be used multiple times.

Data processing

By entering the necessary information at the time of placing the order, the Buyer confirms that he has read the terms and conditions and agrees that the data provided by him are used to ensure that the Seller accepts the Buyer’s order and delivers the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer’s order will be sent to the specified e-mail.

Dispute Resolution Rules

Disputes about the fulfillment of obligations are resolved through negotiations. The Buyer, who is considered a consumer within the meaning of laws and regulations, has the right to use alternative dispute resolution options in accordance with the procedures established by laws and regulations by submitting a written submission to the Seller regarding out-of-court dispute resolution, indicating:

1. name, surname, contact information;

2. the date of submission of the application;

3. the nature of the dispute, the claims and the reasons on which they are based.
